Born from a need for Support & Education

This forum will be chaired by Neil Cunningham between 6.00 p.m. and 7.30 p.m. on Monday 13th July 2015 at Chester le Street Cricket Club.

The proposed subjects for the event discussion will be:

  • Can the act process be invoked by the adjoining owner without a notice and if so, how?  The Smith V Jones Moot held in London will form the basis of our discussion.  We will look at when such action may be necessary; what alternatives may exist, what process may be involved and discuss the potential advantages and disadvantages of taking this course of action.
  • Recovery of fees.  We will cover what are reasonable fees; where, when and how should fees be dealt with in the dispute process, how should fees be levied and what steps can be taken to recover fees when they are not paid.
  • Security for expenses and why they should be requested.  We will briefly cover what are expenses, who can request security for expenses, why are they needed, what is involved in obtaining a security deposit and how can this be done.
