Dispute arising or deeming to arise in accordance with section 10(1) without the serving of party wall notices i.e. where damage to the adjoining owner’s property has been caused by the building owner’s during the execution of notifiable works; the starting of notifiable works in breach of party wall legislation and the non-service of notices etc.
The appointment of a second surveyor under section 10(4)(a) or (b). Problems that occur during this process i.e. does an appointed surveyor need to provide proof of his appointment etc.
