The Faculty has organised a Forum Webinar which will be presented to you by ZOOM on Wednesday 3rd July 2024 at 4.30 p.m. until 6.00 p.m.

Shaw Kelly (Barrister) will be delivering on the following:

  • Section 17 in the Magistrates’ Court

The presentation is a comprehensive exploration of the roles and responsibilities of party wall surveyors, focusing on the recovery of fees through the Magistrates’ Court and County Court systems. It covers the pros and cons of pursuing claims in these courts, the nuances of Magistrates’ Court jurisdiction, and specific sections of relevant legislation. The presentation delves into the complexities of claims and defences under Section 10(16) and Section 17 of the Party Wall etc. Act 1996, and the importance of precise drafting in legal documents. It also discusses the enforcement of civil debt orders, including the use of charging orders and other mechanisms. The forum concludes with strategies for successful claims and a Q&A session.

We cannot be responsible for anyone that does not attend the zoom meeting and please note that we will not provide video recordings of events that are missed.
