Shaw Kelly of Boundary Barristers and Nigel Lassetter of Manor House Surveyors will be delivering on the following:
- Retrospective Agreements and Expert Determination Outside the Party Wall etc. Act 1996
This session will examine the practical and legal issues arising where works have been undertaken without proper compliance with the Party Wall etc. Act 1996, or where the dispute must be resolved outside the statutory process. The presentation will address retrospective agreements, expert determination the limits of statutory jurisdiction, and the practical routes available to parties seeking to regularise matters and resolve disputes after the event, including the necessity of a possible CPR 35 compliant report.
The format will be a discussion-based between Shaw and Nigel, using minimal slides with a Q&A session.
Shaw Kelly is a seasoned barrister with more than 30 years of experience in criminal and commercial law. Currently specialising in property and commercial law, he is a recognised authority on boundary and property dispute resolution.
Notably, he is an expert on the Party Wall etc. Act 1996, and has been honoured with membership in the prestigious Faculty of Party Wall Surveyors. In addition to his legal practice, Shaw provides highly regarded seminars and training programmes aimed at both legal professionals and building surveyors. His notable successes in high-profile legal cases have made him a sought-after consultant and speaker in the areas of property law and dispute resolution. His depth of expertise and commitment to education make him an invaluable resource in his field.
Nigel Lassetter BSc (Hons), CBuildE FCABE, AssocRICS, FFPWS, MPTS is an esteemed boundary and party wall surveyor with over 25 years of experience. He regularly provides specialised training and CPD events in the West Midlands on behalf of the Faculty of Party Wall Surveyors and the Pyramus & Thisbe Society. An experienced speaker, Nigel is regularly involved in equipping solicitors, barristers, and other professionals with essential knowledge on party wall legislation. He is frequently called upon for his expert consultation in dispute resolution and mediation, assisting both courts and in domestic disputes.

CPD certificates will be issued after the event. Please be aware that if you do not join within the first 30 minutes, you will not receive a CPD certificate. We cannot be responsible for anyone that does not attend the zoom meeting and please note that we will not provide video recordings of events that are missed.
